About these terms

These terms are an agreement between you and YouVS ("YouVS", "we", "us") for the YouVS iPhone app and the website youvs.app. By making an account or using YouVS, you agree to them. They include our Community guidelines, Points terms and Gifts terms. Our Privacy policy explains what we do with your data. If you don't agree, don't use YouVS.

Who can use YouVS

You must be 13 or older. We ask your age before you make an account. If you are under the age of adulthood where you live, a parent or guardian must agree to these terms for you, and where the law requires a parent's consent through Apple, we follow it.

Some things are for adults only (18 or older): buying points or Gems, sending and receiving gifts and the paid box need a birthday you enter that makes you 18 or older; in the iPhone app, playing verses for points needs you to be 18 or older by your birthday or by the age range Apple shares. Teens, and anyone with neither, can never have more than 100 points on one verse.

You can't use YouVS if we closed an account of yours before, or if the law doesn't allow you to.

Your account

Give true information, keep your password safe, and don't share your account. You are responsible for what happens on it. Tell us at support@youvs.app if you think someone else is using it.

Your @name must follow the Community guidelines. We can change or take back a name that breaks them or pretends to be someone else.

Verses and votes

A verse is a head-to-head: players post clips in the same game and the crowd votes for the winner, or in a speed game the fastest time wins. Each person gets one free vote in each verse and can change it while voting is open. Players can't vote in their own verse. Nobody is shown who voted or for whom.

Results come from the votes or times the server records. We can cancel a result, take back what it paid and remove a verse when we find cheating, fake accounts, a fixed vote or a mistake. Prizes in verses are points, badges and other in-app rewards, never money.

Rewards, the weekly contest and invites

Daily streaks, mystery boxes, levels, badges and card skins are in-app rewards. Mystery boxes you earn are free; what one gives is decided by chance, and every prize stays in the app. The weekly contest is free to enter and pays points; its Official rules, shown in the app, are part of these terms. When you Send a friend a verse and they join, YouVS can put in up to 50 points for each of you in your first points verse together. We can hold back or take back rewards, contest prizes and free points won by cheating, fake accounts or more than one account per person.

Points

Points are for playing in the app. They have no cash value, are never paid out, and can't be exchanged for money. Adults can buy point packs in the app through Apple. Bought points can only be spent in the app (on things like card skins and the paid box); they can never be put on a verse. The Points terms have the details.

Gems and gifts

Adults can buy Gems in the app through Apple and use them to send gifts to creators for their clips and lives. A gift is a payment for content, not a donation, and it never changes votes or results. 1 Gem counts as 1 US cent of gift value; to the buyer Gems have no cash value and can't be cashed out or refunded except by Apple. Creators earn 50 % of the value of gifts they receive. Earnings are held, and cashing out is not available yet. The Gifts terms have the details.

The paid box

The paid box costs points and pays prizes in points, never money. It is for adults (18+). The chance of every prize and the average return are shown in the app before you open one, and you confirm you have seen them.

Purchases through Apple

In the iPhone app, everything you buy is an Apple In-App Purchase. Prices are the ones the App Store shows you, and Apple's terms apply to the payment. Purchases are final, except as Apple refunds or the law requires. Only Apple can refund them (reportaproblem.apple.com). If Apple refunds a purchase, we take back what it added.

Your content

You keep ownership of the clips, stories, captions, comments, messages and other things you post. By posting, you give YouVS a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, show and share your content on YouVS and in YouVS share links and previews, to make the versions needed to play it on different devices, and to let other people watch it, vote on it, comment on it and answer it in a verse. In a verse, your clip is shown next to the other player's. When you win a verse, others can challenge your winning clip with Beat the champ, which shows a copy of it in their verse.

This licence ends when you delete the content or your account, except for copies other people already received through sharing, copies we must keep for the law or for safety (for example evidence for a report, which we may have to keep for up to a year), and backups that are cleared out in the normal way.

You promise that you have the rights to what you post, that people who appear in it agreed to it, and that it doesn't break these terms or the law.

Filmed and Uploaded

Every clip shows whether it was "Filmed on YouVS" (made in the app's camera) or "Uploaded" (picked from your camera roll). The tag shows how the app says the clip was made. It is a label, not proof. Only upload clips you made, where you appear or you hold the rights. Some verses take filmed clips only, and you always see the tag before you answer a verse with points in it.

The rules

Follow the Community guidelines. They are part of these terms. YouVS has zero tolerance for objectionable content and abusive users. In short: no dangerous acts or drinking games, no sexual content, nothing that harms or sexualises minors, no bullying, harassment or hate, no self-harm content, no posting other people's clips, no fake accounts, spam or cheating.

You also agree not to break the law using YouVS, not to get around a limit, block or ban, not to scrape, copy or overload the service, not to test or break its security, and not to use bots or automated accounts.

Reports, blocks and enforcement

You can report any clip, story, comment, message, profile, game or live, and block or mute anyone. We review reports, and aim to do so within 24 hours. We can remove content, give strikes, pause features for a time, or suspend or close an account that breaks these terms, without warning when the break is serious. Content and accounts we remove may lose points, Gems and earnings tied to the break. If you think we got it wrong, write to support@youvs.app.

We don't check everything before it is posted, and we are not responsible for what other people post. What you see from other people is their view, not ours.

Stories and messages

A story shows for 24 hours (48 if you pick it on the website), then stops showing. A reply to a story is a message to its author. Messages, photos and GIFs in chats follow the Community guidelines like everything else, and can be reported. Someone you don't follow can send you only a few messages until you reply or follow them, and no photos; when either person is under 18 or hasn't given us a birthday, photos need both people to follow each other. You can block anyone. Send photos only of yourself or with the agreement of the people in them.

Copyright

If something on YouVS uses your work without your permission, report it in the app with "Not their clip", or email support@youvs.app with: a link to it, what work is yours, your name and contact details, and a statement that you are the owner or act for the owner and that the information is accurate. We remove content when we receive a valid notice and tell the person who posted it, who can reply if they think it was a mistake. We close the accounts of people who repeatedly post work that isn't theirs.

Deleting your account

You can delete your account any time in the app: Settings, then Delete account. If you are in a verse that hasn't finished, we hide your account at once and finish the deletion when it ends, within 7 days. Unspent points, Gems and gift earnings are lost and are not refunded. You can also stop using YouVS at any time.

Our service

We work hard to keep YouVS running, but we can't promise it will always be available, free of errors or keep every feature. We may change, add or remove features, games, prizes and limits, and we may end YouVS. Some features may be marked as tests.

YouVS is provided "as is". To the extent the law allows, we give no warranties beyond those in these terms, and we are not liable for indirect or consequential losses, lost profits or lost data, or for more than the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the consumer law where you live, or our liability for things the law doesn't let us exclude.

Apple and the App Store

If you got the app from Apple's App Store, these points also apply:

These terms are between you and YouVS, not Apple. YouVS, not Apple, is responsible for the app and its content.

Your licence to use the app is a limited, non-transferable licence to use it on Apple-branded products you own or control, as the App Store's Usage Rules allow (family members may use it through Family Sharing where the App Store allows).

Apple has no duty to provide maintenance or support for the app. Contact us for support.

If the app fails to meet a warranty that applies, you can tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty duty for the app. YouVS, not Apple, handles any other claims, losses or costs from a warranty failure.

YouVS, not Apple, is responsible for any claims about the app or your use of it, including product liability claims, claims that the app breaks a law or regulation, and claims under consumer protection, privacy or similar laws.

If someone claims the app or your use of it infringes their intellectual property, YouVS, not Apple, is responsible for looking into it, defending it, settling it and resolving it.

You confirm that you are not in a country under a US government embargo or named by the US government as a "terrorist supporting" country, and that you are not on a US government list of prohibited or restricted parties.

You must also follow the terms of any third party you use with the app, such as your mobile carrier.

Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you.

Changes to these terms

We may change these terms. When we do, we update the version and date on this page and tell you in the app if the change is important. If you keep using YouVS after a change, you accept the new terms. For purchases, we ask you to accept the new Points or Gifts terms before your next one.

Disputes

If you have a problem with YouVS, write to support@youvs.app first and we will try to fix it. These terms are governed by the laws of the place where YouVS is established, without taking away the protection of the consumer laws of the country where you live, and you can bring a claim in the courts of that country.
